The BOILERMAKERS LODGE NO. 154 WELFARE FUND ( the “FUND” or “We”), a multiemployer employee welfare benefit plan, maintains a web portal https://boilermakers154.lh1ondemand.com and offers a mobile application for download (hereinafter, collectively, the “Site”) through an agreement with WEX Health, Inc. (hereinafter “WEX”). This privacy policy (the “Policy”) describes the types of information that we gather from users (each, “you”, “your”, or a “User”) of the Site and how we use the information that we gather. To the extent information is gathered or used by WEX in addition to that described herein, such information and usage is subject to WEX’s privacy policy.
Please read this Policy carefully before accessing the Site as the Policy applies to the Site and your interactions with the FUND through the Site. The Policy constitutes an agreement between you and the FUND. By accessing the Site, you signify that you have read this Policy and agree to be bound by it.
We may update this Policy from time to time. Please check this Policy periodically for changes. Each time you use the Site, the current version of the Policy will apply. If you do not agree with the Policy, you may not access or otherwise use the Site.

We may collect information and data from or associated with Users in a variety of ways, including, but not limited to, when Users visit the Site, register on the Site, file claims, upload claim substantiation documentation or fill out a form, and in connection with other activities, services, features, or resources we make available on the Site.

· in email, text, and other electronic messages between you and the FUND;
· through mobile and/or desktop applications available from the FUND;
· upon submission by you to the FUND; or

In registering your account and processing claims, you may be asked to provide personal information about you or your dependent spouse and children or beneficiaries. By voluntarily providing information or using this Site, you consent to the collection and use of such personal information in accordance with the Policy.

How we protect your information
We adopt appropriate data collection, storage, and processing practices and security measures to protect against unauthorized access, alteration, disclosure, or destruction of your personal information. WEX has industry standard security measures in place to protect the loss, misuse, and alteration of the information. However, no means of transmission is 100% secure; while we strive to use commercially acceptable means to protect your personal information, we cannot ensure or warrant its absolute security. Consequently, when you transmit your personal information to us, you do so at your own risk.
Sharing your personal information
Other than as provided in this Policy, we do not sell, trade, or rent any User’s personal information to other parties. We may disclose your personal information if and as needed to administer the Funds, respond to your inquiries, comply with applicable law, operate the Website, or protect the rights, property, and safety of the Fund or others.
Trusted Service Providers
In addition to the technical and navigational information that WEX collects about your experience on the websites, these websites display personal information about you, such as your account balances and transactional activity. We and WEX place technical and procedural limits on who can access your personal information. We or WEX may sometimes employ other companies and individuals to perform certain functions on our behalf. Examples of such services include analyzing data, providing system monitoring and maintenance, marketing assistance (including direct and targeted marketing), and providing customer service. These Trusted Service Providers have access to selected personal information needed to perform their functions, but are not allowed to use it for other purposes. In certain circumstances, we or WEX may share your customer information with Trusted Service Providers that need access to your information to provide operational or other support services.
Third party websites
Users may find other content on our Site that links to third party websites. Users may also find links to our Site on third party websites. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. These third party sites and services may have their own privacy policies and customer service policies, some may have no stated privacy policy, and these policies may be subject to change. Browsing and interaction on any other website, including websites that have a link to our Site, is subject to that website’s terms and policies. We are not responsible for the privacy policies or procedures of websites operated by third parties, including WEX.
Data Retention
All User data is stored in accordance with industry standards and may include local storage and storage in the cloud. If at any time a User wishes to delete their data or revoke their consent for the FUND to use and/or share their data, they may delete the application and make the request by sending an email to the address shown below.
Your California Privacy Rights
California Civil Code Section § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Further, effective January 1, 2020, the California Consumer Privacy Act (CCPA) allows California residents to request access to the personal information that the business has collected about the consumer. California residents also have the right to submit a request for deletion of information under certain circumstances.
Governing law
Any claim relating to the Site shall be governed by the laws of the Commonwealth of Pennsylvania without regard to its conflict of law provisions. You and the FUND agree to submit to the personal and exclusive jurisdiction of state and federal courts located in Pittsburgh, Pennsylvania.
Entire agreement
This Policy constitutes the entire agreement between us and you and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Site, its contents, and the subject matter of this Policy.
Changes to this Policy
The FUND may update this Policy at any time without prior notice in the FUND’s sole discretion. We encourage Users to frequently check the Site for any changes to the Policy. Any changes to this Policy will apply to information collected from the date of the revised Policy as well as to existing information we hold, regardless of whether the User actually reviewed the changes. You acknowledge and agree that it is your responsibility to review this Policy periodically and become aware of modifications.
Your acceptance of this Policy
By using this Site, you signify your acceptance of this Policy. If you do not agree to this Policy, please do not use the Site. Your continued use of the Site following the posting of changes to this Policy will be deemed your acceptance of those changes.
